Terms of Service

These Terms govern access to and use of MOVIRIQ, an AI-assisted advertising and campaign-management platform owned and operated by IMCO Tech LLC (“IMCO Tech,” “MOVIRIQ,” “we,” “us,” or “our”). By accessing or using MOVIRIQ, you agree to these Terms.

1. Service

MOVIRIQ may assist with campaign planning, creative generation, advertising workflows, publishing, integrations, performance analysis, recommendations, reporting and related functions. Features may rely on external providers and may change as those providers change.

2. User Review and Responsibility

You remain responsible for reviewing and approving campaign settings, budgets, targeting, schedules, claims, creatives, generated content, landing pages, intellectual-property rights, regulatory compliance and final publication decisions. Automated or AI-generated outputs may contain errors, omissions, unsuitable content or inaccuracies and must be reviewed before use.

3. No Guarantee of Results

MOVIRIQ does not guarantee impressions, reach, clicks, leads, conversions, sales, revenue, ROAS, profitability, ad approval, account availability, audience performance or any other advertising or commercial outcome. Estimates, recommendations and past performance do not guarantee future results.

4. Third-Party Services

MOVIRIQ may connect to, depend on, route through or use third-party advertising networks, social networks, video/image/audio generation providers, AI models, APIs, cloud/hosting infrastructure, analytics providers, payment processors, authentication services, data providers and other external services, whether currently integrated or added in the future.

To the maximum extent permitted by law, IMCO Tech LLC is not responsible for third-party availability, outages, delays, output quality, failed generations, moderation, ad rejection, account restrictions or suspension, platform enforcement, API or policy changes, pricing changes, rate limits, data accuracy, service discontinuation, security incidents, loss of access or other acts or omissions of third parties. Third-party services remain subject to their own terms, policies, permissions, charges and decisions.

5. AI and Generated Content

AI and generative systems are probabilistic. Text, images, video, audio, targeting suggestions, plans, analyses and recommendations may be incomplete, inaccurate, duplicated, unsuitable or potentially subject to third-party rights. You are responsible for determining whether an output is appropriate, accurate and lawful for your intended use.

6. Advertising Accounts and Spend

You are responsible for maintaining valid accounts, permissions, billing methods, platform approvals and sufficient funds. Advertising spend and third-party charges are separate from MOVIRIQ fees unless expressly stated otherwise. IMCO Tech LLC is not responsible for third-party advertising charges, rejected campaigns, suspended accounts or platform enforcement decisions.

7. Acceptable Use

You must not use MOVIRIQ for unlawful, deceptive, infringing, abusive or unauthorized purposes, to violate third-party rules, or to publish content for which you lack necessary rights. We may restrict or suspend access where reasonably necessary for security, compliance, protection of users or third parties, or enforcement of these Terms.

8. Intellectual Property

MOVIRIQ software, interfaces, workflows, branding, underlying technology and proprietary materials are owned by or licensed to IMCO Tech LLC. No ownership rights are transferred except as expressly stated.

9. Fees and Payments

Plans, usage units, top-ups and other commercial terms are those displayed or agreed at purchase. External platform fees, advertising spend and third-party charges may be billed separately by the applicable provider. Taxes may apply.

10. Availability and Changes

We may update, modify, suspend or discontinue features for security, compliance, provider changes, maintenance or product improvement. We do not warrant uninterrupted or error-free availability, particularly where functionality depends on third parties.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable law, MOVIRIQ is provided “as is” and “as available.” IMCO Tech LLC disclaims warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted availability.

12. Limitation of Liability

To the maximum extent permitted by applicable law, IMCO Tech LLC and its directors, officers, employees, contractors and affiliates will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or loss of profits, revenue, business, goodwill, data, advertising spend, opportunities or anticipated savings arising from MOVIRIQ, campaigns, AI-generated outputs, integrations or third-party services. Nothing excludes liability that cannot lawfully be excluded.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless IMCO Tech LLC and its directors, officers, employees, contractors and affiliates from claims, losses, liabilities, costs and expenses arising from your content, campaigns, advertising activity, breach of these Terms, violation of law, infringement of third-party rights or misuse of MOVIRIQ.

14. Privacy and Data

Our handling of personal information is described in the MOVIRIQ Privacy Policy. Data deletion requests are described on our User Data Deletion page.

15. Changes

We may update these Terms to reflect changes in the service, law, security requirements or integrations. The effective date will be revised when material updates are published.

16. General

If any provision is unenforceable, the remaining provisions continue to the extent permitted by law. Failure to enforce a provision does not waive the right to enforce it later.
